Throughout these Terms and Conditions, references to “Provision House Recruitment”, “we”, “our” and “us” mean Provision House Online Services CIC trading as Provision House Recruitment.
2. Acceptance of These Terms
By accessing or using the Website, you agree to be bound by these Terms and Conditions.
If you do not agree to these Terms, you must not use the Website.
We reserve the right to amend these Terms at any time. Any updated version will be published on the Website and shall take effect immediately upon publication.
3. Definitions
Candidate means any individual who visits the Website to search for employment opportunities or submit applications.
Job Advertiser means any employer, recruitment agency, employment business, organisation, charity, public authority, sole trader, partnership or other entity advertising a vacancy on the Website.
Job Listing means a vacancy advertisement published on the Website.
Recruitment Services means candidate sourcing, candidate screening, executive search, recruitment consultancy, interview coordination, talent attraction or related recruitment services provided by Provision House Recruitment under separate contractual arrangements.
Services means the services available through the Website, including online vacancy advertising and application management.
Website means https://jobs.provisionhouse.co.uk.
4. Our Services
Provision House Recruitment provides recruitment-related services, including:
- Online vacancy advertising;
- Employer branding;
- Candidate attraction;
- Application management;
- Recruitment support services; and
- Recruitment consultancy services where separately agreed.
The Website allows Job Advertisers to advertise vacancies and receive applications from Candidates.
We do not guarantee:
- The number of applications received;
- The suitability of Candidates;
- The successful filling of any vacancy;
- Any particular recruitment outcome.
5. Self-Service Job Listings
Where a Job Advertiser purchases a Job Listing through the Website, Provision House Recruitment provides a self-service advertising platform through which vacancies may be promoted and applications received.
Unless expressly agreed in writing, the purchase of a Job Listing does not include:
- Candidate sourcing;
- Candidate screening;
- Candidate assessment;
- Recruitment consultancy;
- Interview management;
- Reference checking;
- Skills testing;
- Hiring recommendations; or
- Recruitment campaign management.
The Job Advertiser remains solely responsible for:
- Recruitment decisions;
- Candidate selection;
- Interviews;
- Employment offers;
- Employment contracts;
- Right-to-work checks;
- Regulatory compliance;
- Employment law obligations.
6. Recruitment Services
Provision House Recruitment may separately provide Recruitment Services to clients.
Nothing within these Terms shall prevent Provision House Recruitment from separately providing permanent recruitment services under a separate contractual agreement.
Where a client engages Provision House Recruitment to provide Recruitment Services, those services shall be governed by separate Terms of Business, Service Agreements or other written contracts.
Where any inconsistency exists between these Terms and a separate recruitment agreement, the recruitment agreement shall prevail.
7. Eligibility
To use the Website you must:
- Be at least 18 years old;
- Have the legal authority to enter into contracts;
- Provide accurate and truthful information.
You are responsible for ensuring all information supplied through the Website is current and accurate.
8. User Accounts
Users may be required to create an account to access certain Website features.
You are responsible for:
- Maintaining account security;
- Protecting login credentials;
- All activity occurring under your account.
You must notify us immediately if you become aware of any unauthorised access to your account.
9. Job Listings
All Job Listings are paid advertisements.
Publication of a Job Listing is subject to:
- Successful payment;
- Acceptance by Provision House Recruitment;
- Compliance with these Terms.
We reserve the right to refuse, edit, suspend or remove any Job Listing where we reasonably believe it breaches these Terms or applicable law.
10. Accuracy of Vacancies
Each Job Advertiser warrants that:
- Every vacancy advertised is genuine;
- They are authorised to advertise the vacancy;
- Information provided is accurate and current;
- Salary and benefits information is not misleading;
- The vacancy complies with all applicable laws and regulations;
- The vacancy does not unlawfully discriminate against any person or group.
Provision House Recruitment may request evidence to verify a vacancy and may suspend or remove any advertisement where such evidence is not provided.
11. Prohibited Content
Users must not publish content which:
- Is false or misleading;
- Is fraudulent or deceptive;
- Promotes unlawful activities;
- Breaches employment law;
- Contains discriminatory content;
- Infringes intellectual property rights;
- Contains offensive, threatening or defamatory material;
- Harvests personal information unlawfully;
- Contains malicious software, code or links.
Provision House Recruitment reserves the right to remove any content that violates these requirements.
12. Candidate Applications
Candidates may apply directly for vacancies advertised on the Website.
By submitting an application, the Candidate:
- Confirms that information provided is accurate to the best of their knowledge;
- Consents to their application being shared with the relevant Job Advertiser;
- Understands that recruitment decisions remain solely with the Job Advertiser.
Provision House Recruitment is not responsible for decisions made by Job Advertisers regarding interviews, offers, employment or rejection of applications.
13. Candidate Information
Job Advertisers may access information relating only to Candidates who have applied for their vacancies.
Job Advertisers must:
- Use candidate data solely for recruitment purposes;
- Comply with UK data protection legislation;
- Maintain appropriate security measures;
- Not sell, share or misuse Candidate data.
Any misuse may result in suspension or termination of access to the Website.
14. Fees and Payment
All Job Listings must be paid for in advance.
Prices displayed on the Website:
- Are in Pounds Sterling (£);
- May be amended at any time;
- Apply at the point of purchase.
Payment must be successfully processed before a Job Listing becomes active.
15. Refund Policy
Job Listings are digital advertising services which commence once published.
Fees are generally non-refundable once a Job Listing has gone live.
Refunds may be considered where:
- Payment has been taken in error;
- A duplicate purchase has occurred;
- We are unable to provide the purchased service.
Any approved refund shall be made using the original payment method where reasonably possible.
16. Intellectual Property
All intellectual property rights relating to the Website, including:
- Branding;
- Logos;
- Design;
- Software;
- Text;
- Graphics;
- Website content;
remain the property of Provision House Online Services CIC or its licensors.
Job Advertisers retain ownership of content submitted by them but grant Provision House Recruitment a non-exclusive licence to publish, promote and distribute such content for purposes connected with operating the Website.
17. Website Availability
We aim to provide a reliable service but do not guarantee that the Website will:
- Be continuously available;
- Be free from interruption;
- Be error-free;
- Be free from technical issues.
We reserve the right to suspend access for maintenance, upgrades or operational reasons.
18. Data Protection
We will process personal data in accordance with our Privacy Policy.
Personal information may be processed for:
- Account administration;
- Recruitment-related communications;
- Vacancy management;
- Application processing;
- Legal and regulatory compliance.
At present, candidate CVs are submitted as part of the application process and are not maintained as a searchable CV database.
Should searchable candidate profiles, talent pools or CV database functionality be introduced, these Terms and our Privacy Policy may be updated accordingly.
19. Third-Party Websites
The Website may contain links to third-party websites.
We are not responsible for:
- Third-party content;
- Third-party security;
- Third-party services;
- Third-party privacy practices.
Users access third-party websites entirely at their own risk.
20. Limitation of Liability
Nothing in these Terms excludes liability that cannot lawfully be excluded.
To the fullest extent permitted by law, Provision House Recruitment shall not be liable for:
- Loss of profits;
- Loss of revenue;
- Loss of business opportunity;
- Loss of goodwill;
- Indirect or consequential losses.
We do not warrant:
- The accuracy of user-submitted content;
- That vacancies will be filled;
- That candidates will secure employment;
- That any particular recruitment outcome will be achieved.
Where liability cannot be excluded, our maximum liability shall not exceed the amount paid by the relevant Job Advertiser for the affected Job Listing.
21. Suspension and Termination
We reserve the right to suspend or terminate any account where:
- These Terms are breached;
- Fraudulent activity is suspected;
- Unlawful activity is identified;
- Website security is compromised;
- Payment obligations are not met.
We may remove Job Listings without notice where necessary to protect users, the Website or our legal obligations.
22. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remainder shall remain in full force and effect.
23. Waiver
Any failure by Provision House Recruitment to enforce a right under these Terms shall not constitute a waiver of that right.
24. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.
Any dispute arising from these Terms or use of the Website shall be subject to the exclusive jurisdiction of the courts of England and Wales.
